Bream Terms of Service
Effective Date: February 2, 2026
These Terms of Service ("Terms") govern your access to and use of the Bream website, web-based and mobile applications, and related services (collectively, the "Services"), operated by Bream Health, Inc. ("Bream," "we," "our," or "us").
By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Services.
1. Who May Use Bream
Bream is designed for women aged 55 and older seeking meaningful connection through groups, events, and shared experiences.
To use the Services, you must:
- Be at least 18 years old
- Be capable of forming a binding contract
- Provide accurate and truthful information during account creation
Bream does not verify age and relies on self-selection into the community.
2. Your Account
To use Bream, you must create an account.
You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Be responsible for all activity under your account
You may not:
- Share your account with others
- Impersonate another person
- Create multiple accounts to circumvent safeguards
Bream is not responsible for losses resulting from unauthorized access to your account.
3. Community Standards & Conduct
Your use of Bream is subject to our Community Guidelines, which are incorporated into these Terms by reference.
You agree not to:
- Harass, abuse, threaten, or harm others
- Share unlawful, misleading, or inappropriate content
- Solicit, advertise, or promote products or services without permission
- Attempt to exploit, manipulate, or deceive other members
- Interfere with the operation or security of the Services
We reserve the right to moderate content, remove material, or suspend or terminate accounts at our discretion if these Terms or the Community Guidelines are violated.
4. Content You Share
Bream allows you to post, share, and participate in discussions and events ("User Content").
You retain ownership of your User Content.
By posting or sharing content on Bream, you grant us a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content solely for the purpose of operating and improving the Services.
You represent that:
- You have the right to share the content
- Your content does not violate any laws or third-party rights
We are not responsible for User Content posted by members and do not guarantee its accuracy or appropriateness.
5. In-Person Events & Meetups
Bream may help members discover or organize in-person gatherings.
Unless explicitly stated otherwise:
- Bream does not host, supervise, or control in-person events
- Members attend events at their own discretion and risk
- Bream is not responsible for the conduct, safety, or actions of individuals at in-person meetups
- Bream does not conduct background checks on members or event participants
You are responsible for your own safety and decisions when attending in-person activities. You recognize that there are possible risks associated with participation in these events and activities. You hereby acknowledge you are in good health and are not aware of physical limitations that will limit your ability to participate, and by agreeing to participate, you voluntarily assume all risks related to such participation.
6. Payments & Subscriptions
Bream offers paid subscription plans on a monthly or annual basis. By selecting a plan and providing payment information, you authorize Bream to charge your payment method on a recurring basis at the rate disclosed at the time of purchase.
Free Trial. Bream may offer a free trial period of one month. To activate a free trial, you must provide valid payment information. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid plan and your payment method will be charged. You can cancel at any time through your account settings before the trial ends.
Recurring Billing. Subscriptions renew automatically at the end of each billing cycle (monthly or annual, depending on your selected plan) unless you cancel before the renewal date. You authorize Bream to charge your payment method on file for each renewal.
Payment Processing. Bream offers subscriptions through two payment paths:
- Subscriptions purchased through the Apple App Store are processed by Apple. Apple controls all billing, currency conversion, and refunds for these purchases. Refund requests for App Store purchases must be directed to Apple. Bream has no control over and does not store payment information for App Store transactions. These purchases are subject to Apple's standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
- Subscriptions purchased through our website are processed by Stripe, Inc. Your payment information is transmitted directly to Stripe and is not stored by Bream. Use of Stripe is subject to Stripe's own Terms of Service and Privacy Policy.
Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle. You will retain access to the Services through that date.
No Refunds. All fees are non-refundable, including in cases of early cancellation, unused subscription periods, or partial billing cycles, except where required by applicable law. For subscriptions purchased through the Apple App Store, refund requests are governed by Apple's policies and must be directed to Apple.
Price Changes. Bream reserves the right to change subscription pricing at any time. We will provide advance notice of material price changes. Continued use of the Services after a price change takes effect constitutes your acceptance of the new pricing.
Failed Payments. If a payment fails, we may retry the charge and may suspend your access to the Services until payment is successfully processed.
6A. Rewards Wallet & Affiliate Offers
Bream may offer a Rewards Wallet feature through which members can access exclusive discounts, offers, and promotions from a curated set of third-party partner brands ("Rewards Partners").
How It Works. Discounts and offers are made available to eligible members in the form of unique discount codes or pre-applied affiliate links. These offers are redeemed directly through each Rewards Partner's own checkout process. Bream does not process or facilitate these transactions.
Affiliate Disclosure. Bream may receive a commission or other compensation when members make purchases through affiliate links or codes provided in the Rewards Wallet. This does not affect the price you pay. We are transparent about this relationship: Bream only partners with brands we have vetted and believe are relevant and valuable to our community.
Curated Partners. All Rewards Partners are selected by Bream. We do not operate an open marketplace. Partner availability may change over time.
Third-Party Responsibility. Purchases made through Rewards Partners are transactions between you and that third party. Bream is not a party to those transactions and is not responsible for the products, services, fulfillment, returns, or customer service provided by Rewards Partners. Any disputes should be directed to the applicable partner.
No Guarantee of Availability. Rewards offers are subject to availability and may be modified, paused, or discontinued at any time without notice.
7. Termination
You may stop using Bream at any time by cancelling your account.
We may suspend or terminate your access to the Services if:
- You violate these Terms or the Community Guidelines
- Your conduct creates risk or harm to others or to Bream
- We are required to do so by law
Termination does not eliminate obligations incurred prior to termination. Upon termination your membership will be cancelled. Membership cancellation takes effect at the end of your current billing cycle. Access to your account will be revoked immediately.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available."
To the fullest extent permitted by law:
- We disclaim all warranties, express or implied
- We do not guarantee uninterrupted or error-free service
- We do not guarantee that connections formed through Bream will meet your expectations
Use of Bream is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, Bream and its affiliates will not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, goodwill, or opportunities
- Personal injury or property damage arising from in-person events
Our total liability for any claim arising out of or relating to the Services will not exceed $100 or the amount you paid to Bream in the past 12 months, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Bream from claims, damages, losses, and expenses arising from:
- Your use of the Services
- Your User Content
- Your violation of these Terms or the Community Guidelines
11. Dispute Resolution & Arbitration
You and Bream agree to resolve most disputes through binding arbitration, rather than court, except where prohibited by law.
Key points:
- Arbitration will be conducted on an individual basis
- You waive the right to a jury trial
- Class actions are not permitted
Either party may bring claims in small claims court if eligible.
This section survives termination of your account.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time.
Material changes will be communicated via the Services or email.
Continued use of Bream after changes constitutes acceptance of the updated Terms.
